CAN-SPAM Compliance Rules and Acceptance

Effective Date: April 12, 2026 
As an affiliate or advocate in the Precision Health Advocate (PHA) Affiliate Program, you are required to comply with all applicable email marketing laws, including the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 ("CAN-SPAM Act") and any applicable state laws. Failure to comply may result in immediate termination from the Program, forfeiture of unpaid commissions, and potential legal liability. Violations of the CAN-SPAM Act can result in penalties of up to $51,744 per non-compliant email.

1. What the CAN-SPAM Act Requires


No False or Misleading Header Information: Your "From," "To," "Reply-To," and routing information must be accurate and identify the person or business who initiated the email. You may not use a false identity.
No Deceptive Subject Lines: The subject line must accurately reflect the content of the email.
Identify the Message as an Advertisement: Your email must include a clear and conspicuous disclosure that the message is an advertisement or solicitation.
Include Your Physical Mailing Address: Every commercial email must include your valid physical postal address.
Provide a Clear Opt-Out Mechanism: Every email must include a functional opt-out/unsubscribe mechanism. You must honor opt-out requests within 10 business days.
Operational Period: Your unsubscribe mechanism must be operational for at least 30 days after the email is sent.


2. Additional Zenith Vital Wellness Email Rules


Permission-Based Lists Only: You may only send promotional emails to individuals who have explicitly opted in to receive communications from you. Purchased, rented, or scraped lists are strictly prohibited.
Affiliate Disclosure: All promotional emails must include a clear disclosure of your affiliate relationship with Zenith Vital Wellness™.
Frequency Limits: Do not send more than three (3) promotional emails per week to any individual recipient regarding Zenith Vital Wellness™ products.
No Health Cure Claims: Emails may not claim that any product cures, treats, prevents, or diagnoses any disease or medical condition.
Brand Accuracy: Use only approved product names and descriptions. Do not alter pricing or invent promotional offers.
Spam Complaint Monitoring: Participation may be suspended if spam complaints exceed a 0.1% rate.


3. Record-Keeping and Enforcement

Affiliates must maintain records demonstrating compliance, including proof of opt-in consent and copies of all promotional emails, for at least three (3) years. Violations may result in written warnings, account suspension, immediate termination, or forfeiture of commissions.

This Policy describes how Zenith Vital Wellness™ LLC collects, uses, stores, and protects information from participants in the PHA Affiliate Program managed through the iDevAffiliate platform.

1. Information We Collect
1.1 Information You Provide:

Full legal name and preferred display name
Email address and phone number
Mailing address
Website URL and/or social media handles
PayPal email or payment information
Tax identification information (SSN or EIN)


1.2 Information Collected Automatically:

IP address, browser type, and device information
Affiliate link click data and conversion tracking cookies
Performance metrics: impressions, clicks, and commission amounts


2. Cookies and Tracking

The program uses cookies with a 90-day attribution window to track referrals. These cookies are essential to the operation of the Program and cannot be disabled while participating.

3. How We Use Your Information


Processing your affiliate application and managing your account
Tracking referral clicks and sales to calculate commissions
Issuing payments and generating 1099-MISC tax forms
Monitoring compliance with terms and detecting fraud


4. Data Retention and Security

We implement technical and physical safeguards to protect your personal information. We retain your affiliate data for the duration of your participation and for a period of seven (7) years after termination to comply with tax reporting obligations.

5. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, delete, or request portability of your data. California residents have additional rights under the CCPA. To exercise these rights, contact affiliates@zenithvital.com.
